1. Agreement to Terms

By accessing or using the Hawfinch platform, you agree to be bound by these Terms of Service. If you are using the platform on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.

2. Description of Service

Hawfinch provides an enterprise lead management platform with dedicated infrastructure, including lead ingestion, validation, routing, campaign management, analytics, and reporting services. Access to the platform is provided on a subscription basis as agreed in your service contract.

3. Account & Access

Access to Hawfinch is granted following a sales consultation and onboarding process. You are responsible for maintaining the confidentiality of your account credentials and API keys. You must notify us immediately of any unauthorised use of your account.

4. Acceptable Use

You agree not to use the platform for any unlawful purpose or in any way that could damage, disable, or impair the service. You must comply with all applicable laws and regulations regarding lead generation, data protection, and electronic communications.

5. Data & Privacy

Your data is stored on dedicated infrastructure isolated from other customers. We process data in accordance with our Privacy Policy and applicable data protection legislation. You retain ownership of all data you submit to the platform.

6. Service Level Agreement

We target 99.99% uptime for all core services. Specific SLA terms, including remedies for downtime, are detailed in your service contract. Current system status is available on our Status Page.

7. Limitation of Liability

To the maximum extent permitted by law, Hawfinch shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

8. Termination

Either party may terminate the service agreement in accordance with the terms of the signed contract. Upon termination, we will provide a reasonable period to export your data before it is securely deleted from our systems.

9. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the platform. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
